Whilst there is no specific offence for making a false report under the Children, Youth and Families Act 2005, there are more general laws concerning the making of false complaints to Police.
Crimes Act 1958 Section 83A - Falsification of Documents
You would lose your protection against civil liability and disclosure of identity.
There is no specific offence under the Children, Youth and Families Act 2005 for making a false report – but there are more general laws in Victoria concerning the making of false complaints to Police. Crimes Act 1958 Section 83A - Falsification of Documents could be applied for knowingly making a false complaint.
This would include providing false information to DFFH knowing there’s a reasonable likelihood of the information being provided to the police.
More importantly, a false report is not made in good faith or honestly, so therefore you would lose any protection you have under the Children, Youth and Families Act 2005 against civil and criminal liability and disclosure of identity.
